1. Pro Se
If you and your spouse are divorcing and neither one of you plans to contest it, it is possible to divorce without an attorney. Call pro se, this means you are representing yourself, and you should consider this option if there are few marital assets and no children. A do-it-yourself divorce can save both of your thousands of dollars in legal fees. But the divorce process can be extremely complex, and most people do need legal help somewhere along the way. If you have children, you should get legal representation unless you and your spouse are incredibly agreeable as to their welfare. Most people agree it's not wise to represent yourself if your spouse decides to hire an attorney.
2. Laws of Your State
Each state has some variance in its divorce laws, so you will need to become familiar with your state's laws. In any legal situation, there seems to be an extraordinary amount of paperwork you are required to file. Pay a visit to your local Clerk of the Court's office, explain you are representing yourself and ask for a list of documents you will need to file. You should also check your state's official website to get more information. Keep on top of filing deadlines. It may be wise to hire a paralegal to help you with the paperwork and the language of the law.
3. Stay Calm
You will need to find a way to stay calm and as unbiased as you can during the process. If you can look at your divorce as simply a business matter, you will be more likely to get through it quickly. Don't let the emotional aspects of ending your marriage interfere with your ability to manage the paperwork load and filing dates.
4. Order a Kit
Some people order do-it-yourself divorce kits online. Again, this can work only if you have a simple divorce, and both of you decide this is the best way to pursue the legal end to your marriage. The advantage of a divorce kit is that it will give you all the steps you need to follow. Make sure the kit is specific to your state.
5. Take a Vacation
You can also get an easy divorce out of the United States. There are companies that will make all the travel and legal arrangements for you. Although the price is not cheap, it is usually thousands less than using attorneys. You also get a vacation thrown in, usually in Mexico or the Bahamas. Use this option only if there are no children from your marriage and you have already divided any financial assets.
