Age of Consensual Sex
Overview
The following laws are the ages for sexual consent in the United States only. The age of sexual consent is the age when the law says you can agree to have sex. This means that until you reach this age, you can not legally have sex with anyone, regardless of whether or not you or your parents consent. Sometimes the law is different if you are female or male. Some states also have different ages of consent for homosexual intercourse. As with any laws, these are subject to change. If you are younger than age 18, please check these laws in the state in which you reside.
These laws exist because some teens are not mature enough to know that their actions have consequences. The law makes sure that young people are not exploited by adults.
Statutory rape is the crime committed when an adult has sexual intercourse with someone under the legal age of sexual consent. If the crime is reported (even if your partner is your boyfriend/girlfriend), that person may be arrested, tried in a court of law and sent to jail.

I dont want to be getting in trouble but i need help understanding washington states consent law.
i under stand the age is 16--however; when i went and actually read the law it says that rape is commited if the younger is between 14-16 and the older is more than 48 months (4 years). So cant technically a 15 1/2 year old and a 19 year old have consensual sex?

You have to becareful. Because at that age the parents may be able to file charges if she is 15 1/2. you have to do alot of research on the laws because there are many many statutes to these laws.

She is under 16. Wait until she is 16. At that pount she does not need any consent other than her own. Keep in mind, no matter how old she is, can still cry rape. Once she is 16, and she consents, your age, as long as you are over 16, does not matter.

Check out your Washington state AoC laws. It says 16. As for marriage, why not ask a priest, justice of the peace, etc? Usually marriage laws are lower than AoC laws.

You need to know if your state has an age gap limitations. Some states say that its only legal for a 16 year old to have sex with someone who isnt more then 2 to 4 years older. The law very rarely has any statutes that say its ok if you are "almost old enough"

It depends on the state you live in, in most states there's an age window for example in Minnesota you must be within 36 months if your partner is underage. And most laws state that the age requirement must be met at the time of conception.

that is not true. where ever you got ur information from it is wrong. if you are under the age of consent you can still have sex with someone the same age as you or someone who is under the age of consent law too. as long as it is not someone who is older than the age of consent. and as long as they are not too much younger than you. legally you can. but whether your parents or guardians allow it thats a different story.

Keep in mind that laws are constantly changing and new laws are constantly being added. Also remember that the law is the law. Love, parental consent and any other factors have nothing to do with it. Parents consenting does not legalize underage sex. In some cases there are lower ages of consent if you are married, and in some cases if parents consent you can get married at a lower age, but that's the closest thing.

You can't press charges for dating, but if you have done anything sexual (in some cases kissing can count, not sure on Texan law) then they could if they could get proof for it.

It's good to get information out but it's better if they don't mislead with the wording. For example: "These laws exist because some teens are not mature enough to know that their actions have consequences. The law makes sure that young people are not exploited by adults."
It doesn't just exist because some teens aren't mature enough, but also because even more preteens are not. Furthermore, many postteens may not be mature enough either, yet 18+ receive no protection if they aren't informed enough, not unless they're so far gone as to be declared retarded or something. Furthermore, the law doesn't make sure that young people aren't exploited by adults, because many adults still exploit young people.
It just decreases (different from eliminating) sexual exploitation. Even then, it still occurs illegally. One wonders, if one had a legal alternative, one could seek out a law-abiding partner who may be less abusive, as opposed to restricting it to those who break laws?

yes it does. because in some cases the mental maturity of the minor comes into play. if parents can prove that the minor wasnt mentally mature enough to make the desicion then they may be able to file charges.

I'm 19 and my girlfriend is currently 15. We know the risks decently, so I have decided not to sleep with her until she is 16. But, I've also heard that someone was arrested and imprisoned, even though the 16 year old girl told them it was consensual because her parents charged him. I don't know if this is accurate or not, as the law in the state is 16. So, I need to know if it would be safe for us to sleep together or not. I'm 25 and the girl in which I share a mutual interest is 17. She lives in FLA and she was trying to tell me that the age of consent over there is 16 if your partner is 24 and 17 if they are 25. This sounds a little suspect to me, so that's why I am here. No its not legal. Its still considered as sexual contact no matter if its clothed or unclothed. Believe it or not there have been 17 year olds placed on Registered Sex Offenders list for sexual contact with minors. Do you want to risk that?

I'm a 16 year old female in Ohio, very shortly to be 17. At 14, I met a Canadian guy who ocassionally visits family here (age 21) and we knew the gap was WAY too big, so we agreed to be "friends" who wanted more,..I guess you could say. We've been very good about waiting to do anything illegal. I know AoC in Ohio is 16 with the 4 year limit. He is about six years older than me, now 23 years old (birthday in May). We have since I turned 16 agreed to date LDR..So technically this law means I have to wait until 18 to have sex with him, right? I just don't understand because he is Canadian and I dont know how that applies to nonresidents of the united states. Does it change anything for me to say both of my parents are aware and approving of this relationship?

To be safe you should wait until your 18. In most cases the laws only apply to legal citizens. it is illegal to travel to other countries to engage in sex with minors even if they are at the age of consent. And with the huge age gap it my not even be legal even if your parents did give consent. The safest for you and specially for him is to wait until you are 18.

I need help. My 16 year old son has been accused of having sex in a school bath room with a 14 year old girl. His girl friend for the past few weeks. He denies the accusation but they were seen going into the bathroom together on camera. They had actually just met less than an hour before. But anyway the question is with him being 16 and her 14 almost 15 is there any legal action that her family can take even though nothing happened but she claims it did. She has accused someone else of touching her inapproprately last year at another school we found out. Not sure if it was reported but she told her mother this.

she can go to the doctor and see if there has been recent penetration. or if she claims a condom was not used then a doctor can see if there is any sperm in her body. sperm stays inside you for a week before it dies off.

in some cases if the parents can prove that the 16 year old is not mature enough to make that decission then they are able to file charges.

Generally with age difference, from skimming over several websites, there IS NO LAW FOR DATING, but any sexual contact under 16 can get you in trouble. What can you do on a date? As long as the girl's parents have consent to date, holding hands, kissing in the back of the cinema, no crime there! <

ok i need help so the main of the story is, i met a girl that i didnt know her age till her b-day. after i found out, i was told by the girl and her mother that 16 was the age of consent, and they both consented to our relationship. so we dated for a while but me and her mom got in an argument, and now she threatens to call the cops on me, if her daughter doesnt do everything she says. i didnt know that in arizona the age of concent was 18, even though the girl and her father consent the mom wont let me stop datin the girl or shel call the cops on me!! what can i do?

If this is true then you are between a rock and a hard place. In most states there are statutes that say that not knowing a girls real age is no defense against statuatory rape charges nor is not knowing the legal age of consent. However, if they gave consent for you to date her and to have sex with her then they could also be charged. Not to mention this is blackmail and blackmail is also illegal.

I'm fifteen and from Denmark which is a country in Europe. You have to be fifteen to have sex. If I then go to America can I then have sex with a 23 year old or do I have to stay at the law of the state I'm in? It have been bothering me for a couple of months, so i would really appreciate it if anyone would answer me.

You have to becareful. In that case International law comes into effect. For example usually it is illegal for a man travel to another country to have sex with someone where the age limit is low. Or if he is bringing you to america he could find himself in some very serious trouble. In many cases you have to be a legal citizen of that country in order not be breaking any laws.

depends what the by laws are. Many states have statutes that have age gap stipulations. such as it may be legal for a 16 year old girl to have sex but it could only be legal aslong as the man isnt more then 2 or 4 years older then the girl.

Your parents can't do anything I don't think I know a girl and her parents tried to get her BF in trouble but the cops couldn't do anything about it unless she wanted to press charges to and she didn't. But its depending on what state you live in I think.

So I'm a little confused.... If someone that's 16 and from Iowa and the age is 16 and their with someone from New Jersey that's in their 20's and they have sex would he get in trouble or not I'm confused because the age in both states is 16. So wouldn't that be ok not??

Alright... So here is the big question do you have to be a resident of the state?
For example ill take my situation... i live in missouri.. the age of consent is 17. we live right on the border of Iowa... and the age of consent there is 16.. I dont want my daughter having sex but i cant trap her in the house. She is 16... if older guys take her there and she agrees to it. Its legal?

ok i know the consensual age in Colorado is 17 but i wanted to ask, i turned 18 in august and im wondering if it would be in ANY WAY ILLEGAL for me to have consensual sex/phone sex/ picture messaging with a 17 year old girl in my state or phone sex / picture messaging with a 17 year old girl in another state. Would it vary depending on HER state of residence?
